TrailerLink – Terms and Conditions of Hire

Welcome to TrailerLink! By hiring a trailer from us, you’re agreeing to these Terms and Conditions. Please read them carefully. They form a binding contract between you and TrailerLink.
To make these Terms and Conditions easier to understand, here’s what some key terms mean:
2.1 Acceptance of Terms: A binding contract (the “Hiring Agreement”) begins when you request a Trailer Booking and accept these Terms and Conditions. By clicking “I have read and accept the terms and conditions and privacy policy” on the TrailerLink website, or by proceeding with a phone booking after receiving a link to these Terms and Conditions, you confirm you’ve read, understood, and accept them.
2.2 Your Responsibility: It’s your responsibility to read and understand these Terms and Conditions before accepting them and proceeding with your hire.
2.3 What You Must Not Do: During the Period of Hire, you must not:
2.4 Continued Application: These Terms and Conditions may still apply even after the Completion Date and Time, especially for any outstanding fees, damages, or ongoing investigations related to your hire.

3.1 How to Book: You can book a Trailer in the following ways:
4.1 Information We Collect: You agree that TrailerLink will collect certain information, including your name, contact details, date of birth, address, and driver’s license number, as well as other relevant information necessary for the hire.
4.2 Protecting Your Information: We will take reasonable steps to protect your personal information from misuse, interference, and loss, as well as unauthorised access, modification, or disclosure.
4.3 Marketing & Promotions: You accept that TrailerLink may use your personal information for possible future promotions and offers. You can opt-out of these communications at any time by following the instructions in the promotional material or contacting us.
4.4 Tracking Devices: You acknowledge that the Trailer may have a GPS tracking device fitted for monitoring its location and use.
4.5 Keeping Your Details on File: You acknowledge that TrailerLink may keep your personal information and details on file, including license details, credit card details, and/or bank details, for the purposes of future hires, payment of outstanding fees, or as required by law.
4.6 Full Privacy Policy: Our complete Privacy Policy, detailing how we collect, use, store, and disclose your personal information, is available at Privacy Policy – TrailerLink.
By hiring a Trailer from us, you declare and agree to the following:
5.1 Valid Identification: Your license, credit/debit card, and any other personal identification provided must be current, correct, and in your name.
5.2 Current Address: The address on your driver’s license is your current address.
5.3 Australian Driver’s License: You must hold a current Australian driver’s license to hire a Trailer.
5.4 Conditional Licenses: TrailerLink reserves the right to refuse a hire if your driver’s license is conditional.
5.5 Roadworthy Towing Trailer: Your Towing Trailer is registered and roadworthy.
5.6 No Impairment: You will not use a Trailer while under the influence of any drug or intoxicating alcohol, or with a blood alcohol level that exceeds the percentage permitted by law.
5.7 Remain Contactable: You agree to remain contactable via mobile phone for the duration of the Period of Hire, especially in the event of issues with the Trailer or Hiring Agreement.
5.8 State Use Restriction: You will not take the Trailer outside the state where the Owner Site is located unless you have our prior written permission.
5.9 Reporting Stolen Trailer: If we are unable to contact you after several attempts over a 48-hour period following the Completion Date and Time, we will report the Trailer as stolen to the police.
6.1 Trailer Condition & Return: You acknowledge that at the time of hire, the Trailer is clean, in good serviceable condition, and roadworthy. You agree to return the Trailer in a similar condition. We will document any pre-existing damage or wear and tear to the Trailer at the time of pickup. You should review and agree to this documentation to protect yourself from liability. If, in our opinion, you return the Trailer in a dirty condition, or if you cause excessive wear and tear or damage through neglect, carelessness, or abuse (beyond normal wear and tear expected from reasonable use), you agree to pay for the cleaning and restoration of the Trailer to its original condition. You are responsible for all freight and other charges incurred by us in relation to the delivery and return of the Trailers, unless we authorize otherwise in writing.
6.2 Your Own Insurance (Crucial): You are solely responsible for arranging your own insurance for your Personal Property and the Towing Trailer against loss or damage for any reason. You accept full responsibility for your Towing Trailer, goods, and luggage carried in or on the Trailer. TrailerLink will not accept responsibility for any loss or damage to, or caused by, the same, regardless of the cause.
6.3 Third-Party Liability: You assume all responsibility for any liability, including but not limited to public third-party liability, arising from the use of the Trailer during the hire period.
6.4 Recovery of Outstanding Amounts: You agree to be liable for all reasonable costs we incur in the recovery of outstanding amounts. This includes interest at the rate of 10% per annum, calculated from the due date, debt collectors’ costs and commission, and reasonable legal expenses.
You agree to fully protect and compensate TrailerLink and its associated parties (including directors, officers, employees, agents, etc. – collectively, “the Indemnified Parties”) from any and all actions, claims, damages, losses, costs, and expenses that may arise from or be related to your actions or omissions, or the actions or omissions of anyone acting on your behalf, in the use of the hired Trailer(s). This includes any claims brought by third parties.
Important Note: Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable legislation which cannot be excluded, restricted, or modified by agreement.
8.1 Stated Opening Hours: Our opening hours will be stated on trailerlink.com.au and in your booking confirmation.
8.2 Returns During Opening Hours: The Trailer cannot be hired or returned outside of these Opening Hours for any reason.
8.3 Secure Storage: If you need to store the Trailer overnight before returning it during Opening Hours, you must store it securely.
8.4 Abandonment Fees: Abandonment fees will apply if the Trailer is left outside the TrailerLink Site outside of Opening Hours, as detailed in Section 10.7.
9.1 Storing Card Details: You agree that your debit/credit card details may be stored on file for the payment of any Fees and Charges that may arise under this Agreement.
9.2 Upfront Payment: You agree to pay all Hire Charges stated on the Hiring Agreement prior to commencing the hire of the Trailer.
9.3 Extension Payments: All hire extension fees must be paid upfront before extending a hire.
9.4 Additional Fees: You agree that additional Fees and Charges may apply as per these Terms and Conditions.
9.5 Your Payment Obligation: You agree to pay all Fees and Charges that apply as per these Terms and Conditions of Hire.
9.6 Authorisation to Charge: You authorize TrailerLink to charge your debit/credit card for any applicable Fees and Charges without prior notice.
9.7 Declined Payments: If your debit/credit card declines, you will receive an invoice via email to be paid within 24 hours of issuance.
9.8 Your Financial Responsibility for Fines: You are financially responsible for any speeding fines, tolls, traffic offenses, or other fines and charges incurred during the hire period.
9.9 No Refunds for Early Returns: No refunds are given for returning the Trailer earlier than the Completion Date and Time. However, TrailerLink may, at its sole discretion, provide free credit for a similar value for hiring a Trailer on another date.
The following Fees and Charges may apply in addition to your Hire Charge:
10.1 Hire Extension Fees: All hire extension fees must be paid upfront, prior to extending the Period of Hire.
10.2 Follow-Up Fees: If we need to contact you because the Trailer has not been returned by the Completion Date and Time, a follow-up fee of $10 will be charged per phone call, email, or letter.
10.3 Late Return Fees: If the Trailer is not returned by the Completion Date and Time, a late return fee of one full day’s hire rate per Trailer per day will apply.
10.4 Late Payment Fees: If an invoice for Fees and Charges is not paid by the due date, a late payment fee of $10 per day will apply.
10.5 Administration Fee: An administration fee of $30 will apply per task for processing any fees and charges or additional administration (e.g., processing a fine, dealing with an unpaid invoice).
10.6 Towing Fees: If the Trailer needs to be towed to the TrailerLink Site or a repairer for any reason, towing fees will be charged at the current retail towing rate.
10.7 Abandonment Fee: If you abandon the Trailer for any reason, regardless of its distance from the TrailerLink Site, an abandonment fee of $200 per Trailer will apply. If the Trailer is abandoned 50km or more from the pickup location, you will also be charged additional towing fees of $1 per km for every km over 50 km.
10.8 Cleaning Fees: If the Trailer is returned dirty or full of rubbish, a cleaning fee of $50 will apply per task (e.g., general cleaning). An additional $200 will be charged if rubbish needs to be disposed of at a waste disposal center.
10.9 Damage Fees: If the Trailer is returned damaged or not in its pre-hire condition, damage fees will be charged based on the cost of repairs or replacement, assessed on a case-by-case basis.
11.1 Extending Your Hire: If you wish to extend the Period of Hire, you must first pay the hire extension charge.
11.2 Denial of Extension: TrailerLink may deny an extension if the Trailer is required for another Hirer or for maintenance.
11.3 Terms Apply to Extension: These Terms and Conditions will apply for any extended hire period.
11.4 Returning the Trailer: On completion of hire, you must return the Trailer to the TrailerLink Site at your own expense.
11.5 On-Time Returns: The Trailer must be returned to the TrailerLink Site by the date and time stated on the Hiring Agreement.
11.6 Late Fees Apply: If the Trailer is not returned by the Completion Date and Time, late fees will apply as per Section 10.3.
11.7 Notify Us of Late Return: You must notify TrailerLink immediately if there’s any possibility of a late return.
11.8 Overnight Storage for Late Returns: If the Trailer cannot be returned to the TrailerLink Site during business hours, you must store it securely overnight and return it to us the next day during Opening Hours, with applicable late fees.
Unless you have opted for and paid for the “Trailer Damage Cover” option (as detailed in Section 19), the following applies:
12.1 Not Insured by TrailerLink: You acknowledge that our Trailers are not insured whatsoever against theft or damage while on hire with you.
12.2 Full Financial Responsibility: You will be financially responsible for the full retail replacement costs of any Trailer that is lost, stolen, or damaged while on hire.
12.3 Cease Use if Damaged: You must not continue using the Trailer if it is damaged or requires repairs.
12.4 Return After Breakdown/Accident: In the event of an accident or breakdown, it is your responsibility to return the Trailer to the TrailerLink Site at your own expense.
12.5 Towing to Repairer: If the Trailer needs to be towed to a repairer, this will be done at your expense.
12.6 Beyond Our Repair: If the Trailer is damaged beyond TrailerLink’s repair capability, it will be sent to a repairer for a quote.
12.7 Your Insurance Claim & Police Report: It is your responsibility to make a claim with your insurance company (if applicable) and to contact TrailerLink with the claim number and police report number within 24 hours of the incident.
12.8 Repair Authorization: Once the repairer provides their quote, your insurance company will be contacted to authorize the repair.
12.9 Punctures and Tire Damage: You are responsible and financially liable for all punctures and tire damage to the Trailer while on hire.
12.10 Paint Damage: You will be financially liable for any costs related to respraying the Trailer if the paint is scratched, damaged, removed, or excessively worn in any way.
12.11 No Claim Against TrailerLink: You cannot make a claim for loss or damage against TrailerLink. (As per Section 7, this does not exclude non-excludable consumer guarantees or rights).
12.12 Your Security Responsibility: It is your responsibility to ensure the security of the Trailer and items always covered in these Terms and Conditions.
13.1 Theft Risk: You acknowledge that the Trailer is not covered for theft by us, and you must keep it secure from theft at all times while under your hire.
13.2 Use Security Devices: You agree to keep the Trailer secure with padlocks, chains, or coupling locks at all times while under hire.
13.3 Secure Overnight Location: The Trailer must be stored securely overnight in a secure location (e.g., behind locked gates).
13.4 No Street Parking: You will not leave the Trailer on the street overnight.
13.5 Return Handover: Upon completion of hire, the Trailer must be returned to TrailerLink’s Site and locked up as per our instructions. You will inform us via text or the TrailerLink app when the Trailer has been returned.
13.6 No Abandonment: You will not abandon the Trailer under any circumstances.
13.7 Abandonment Fees Apply: An abandonment fee will apply if you abandon the Trailer for any reason (refer to Section 10.7). This fee also applies if the Trailer is abandoned outside our Site before or after Opening Hours.
14.1 Necessary Skills: You acknowledge that you have the necessary knowledge and skills to use the Trailer without incident or accident.
14.2 Safe Towing & Operation: You have the skills and knowledge to safely tow and operate the Trailer prior to use.
14.3 Safe Use: You agree to use the Trailer skilfully and properly, without speeding or overloading it beyond the rating on the Trailer compliance plate or your Towing Trailer’s tow bar.
14.4 Rest Breaks: Take regular rest breaks when using the Trailer over long distances or for extended periods.
14.5 Pre-Departure Check: You agree to check that the Trailer is properly attached to your Towing Trailer before leaving TrailerLink’s Site.
14.6 Manufacturer Specifications: You agree to use the Trailer only in accordance with the manufacturer’s specifications and not engage in any unsafe activities or actions that may cause damage.
14.7 Jockey Wheel Use: The jockey wheel is for raising and lowering the Trailer only and should not be used to manoeuvre or restrain the Trailer.
14.8 Coupling Device: Keep the coupling device attached to the Towing Trailer at all times when loading, loaded, or unloading.
14.9 No Livestock: You must not use the Trailer to transport cattle, livestock, or any other animals.
14.10 Age Restriction: The Trailer is not to be towed or used by any person under the age of 18 years.
14.11 Avoid Water: You must not take the Trailer through water, rivers, dams, fords, or any other bodies of water that may cause damage to the Trailer or its electrics.
14.12 Road Type Restrictions: You must not take the Trailer on any dirt road, unsealed road, or onto a beach.
14.13 Car Trailer Winch: You must not use the car trailer winch to tie down or secure any vehicle to the car trailer while towing.
14.14 Car Trailer Tie Downs: Use rated tie downs to secure the vehicle to the car trailer on all four corners.
14.15 Traffic Laws: Comply with all traffic laws and regulations while using the Trailer.
14.16 Lights & Chains: It is your responsibility to ensure all light cables, chains, and accessories are correctly attached and in legal working order. TrailerLink is not responsible for them.
14.17 No Lengths: No person will ride in or on a moving Trailer at any time.
14.18 Speed Limit: Do not exceed 90 km/h or any other posted speed limit while towing a Trailer.
14.19 No Overloading: Do not overload the Trailer beyond the rating stated on the Hiring Agreement.
14.20 Load Tie Downs: It is your responsibility to provide load tie downs for the Trailer. TrailerLink is not liable for the tie downs, or the methods used.
14.21 Rated Tie Downs: Use only approved tie downs that are rated to withstand the load capacity required for the job.
14.22 Secure All Loads: Secure all loads within the Trailer’s parameters using suitable tie-down materials and methods. Any loads that project from the Trailer must comply with the appropriate state laws.
14.23 Secure Load: Ensure that no part of any load will detach from or leave the Trailer during transit or otherwise.
14.24 D Shackles: It is your responsibility to provide correctly rated D shackles required to safely carry out the job.
14.25 Manual Handling: Do not lift, carry, or move a Trailer by hand to avoid the risk of injury. Follow correct manual handling techniques when loading or unloading a Trailer and take regular rest breaks to prevent strain or fatigue.
14.26 No Liability for Injuries: You acknowledge that TrailerLink is not responsible for any injuries that may occur while hiring a Trailer.
14.27 Brake Controller (Car Trailers): A brake controller unit must be used at all times while towing a car trailer with electric brakes.
14.28 Report Faults Immediately: Promptly report any faults with the Trailer to TrailerLink by contacting the helpline number provided (24 hours/7 days a week) or calling 1300457099 before further use of the Trailer.
14.29 Cease Use if Faulty: If there are any faults or issues with the Trailer, you will immediately cease using it.
14.30 Breakdown Responsibility: In the event of a breakdown or damage to your Towing Trailer or the Trailer, you agree to arrange the return of the Trailer to TrailerLink at your own expense, on or before the Completion Date and Time.
14.31 No Alterations or Repairs: Do not attempt any alterations, servicing, or repairs on the Trailer, except for adjusting the tire pressure.
14.32 Punctures: Inform TrailerLink of any punctures before changing any tires.
14.33 Condition on Return: The Trailer is provided in a good, clean, and roadworthy condition at the beginning of the hire period. You agree to return it in the same condition.
14.34 Maintain Roadworthiness: It is your responsibility to keep the Trailer in a roadworthy condition. If you believe the Trailer requires attention, you must contact TrailerLink or technical support 24/7 and return the Trailer to arrange a maintenance inspection as soon as possible.
14.35 No Jack or Wheel Brace: No jack or wheel brace is supplied as part of the Hiring Agreement. It is your responsibility to carry your own at all times.
14.36 Tire Condition: It is your responsibility to ensure the Trailer’s tires are in a safe and roadworthy condition at all times.
14.37 Tire Pressure: Maintain the correct tire pressure in all tires, as specified by the manufacturer for both the Trailer and the Towing Trailer.
14.38 Wheel Nuts: It is your responsibility to ensure the wheel nuts are properly tightened to prevent the tires and wheels from separating from the Trailer before use, at each stop, and regularly during long-distance driving.
14.39 Spare Tire: TrailerLink supplies spare tires, which must be carried with the Trailer at all times. You must securely fasten the spare tire to the Trailer at all times. TrailerLink will not be held accountable if the spare tire becomes loose or detaches from the Trailer.
15.1 Termination by TrailerLink: We may, regardless of the specified Period of Hire and without prior notice or written demand, immediately terminate the Hiring Agreement and immobilize or repossess the Trailer if:
15.2 Material Breach: Either you or TrailerLink may terminate the Hiring Agreement at any time if the other party commits a material breach of the Hiring Agreement.
The following uses of the Trailer are strictly prohibited:
TrailerLink shall not be liable to the Hirer for any damages, suits, actions, claims, and demands of every description whatsoever, arising directly or indirectly from representations, warranties, terms and conditions, whether express or implied.
Important Note: This clause does not seek to limit or exclude any non-excludable consumer guarantees or rights available to you under the Australian Consumer Law.
18.1 Cancellation by TrailerLink: TrailerLink may cancel a Confirmed Booking without penalty if the Trailer is unavailable due to unforeseen circumstances, such as not being returned on time by a previous hirer or having been involved in a prior accident.
18.2 Cancellation by Hirer:
19.1 Introduction to Damage Cover: TrailerLink Pty Ltd offers you the option to reduce your liability for damage to the hired Trailer in the event of an accident or theft to a predetermined amount (“Damage Limitation Amount”). This option is called Damage Cover, and it limits your liability for damage to the agreed reduced Damage Limitation Amount for the hired Trailer.
Important: Damage Cover is not insurance coverage. You are responsible for obtaining third-party damage insurance for your Towing Trailer.
19.2 When Damage Cover Does Not Apply (Exclusions): Payment of the Damage Limitation Fee does not limit your liability in any other way, including for any Third-Party Loss, and does not apply under the following circumstances, meaning you remain fully liable for all costs:
19.3 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.
19.4 Dispute Resolution: Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.
19.5 Entire Agreement: This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.
20.1 Applicable Law: The Hiring Agreement and these Terms and Conditions are governed by the laws of Victoria, Australia.
20.2 Jurisdiction: The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of Victoria. Any proceeding brought in the Federal Court of Australia must be initiated in its Melbourne Registry.
